These Terms and Conditions of Sale apply to all online or other types of orders made through the www.quarest.com website. Outlet products not purchased through this website are excluded from this scope. These Terms and Conditions regulate the rights and conditions granted to you by Quarest within the scope of the consumer relationship established between you and QUAREST. By purchasing Quarest products, you are deemed to have accepted these terms and conditions. If you have any questions or requests regarding the process, you can contact us.

1.1 These Terms and Conditions apply to your access to and use of our Website and to any orders you place through the Website, by phone or in store. You agree to these Terms and Conditions by any of the following methods:

1.3 In the event of a conflict between these Terms and Conditions and any other policies, guidelines or rules, these Terms and Conditions shall prevail.

 

2. TERMS OF USE AND INTELLECTUAL PROPERTY RIGHTS

 

2.1 By accepting these Terms and Conditions of Sale, you acknowledge that the intellectual property and commercial rights of all documents published on the www.quarest.com website belong to QUAREST.

These situations are carried out with our professional service providers, and in this context, we would like to inform you that if any suggestion, sales strategy, idea or development sent to our contact addresses by you is not legally protected, the relevant ideas or suggestions may be used by QUAREST. If the thing used in any way has legal protection during use, you are deemed to have given permission to use QUAREST until the moment you notify it.

3. ACCESS TO QUAREST SERVICE

 

3.1 Although we try to ensure that the Website is accessible at all times, 24 hours a day, in cases such as system failures, maintenance, repair work or reasons beyond our control, access to the Website may be temporarily suspended without any notice. QUAREST will not be held responsible if the Website is inaccessible at any time or for any period. 8. DISCLAIMER

10.2 All product prices on the Website and in the store include VAT. Product prices on the Website are shown on the pages as well as in the shopping cart and payment section. Delivery charges are not added to prices including VAT. In orders placed by phone or in store, you will be informed of the applicable delivery charges before the payment process.

 

10.3 If you are eligible for VAT exemption and wish to benefit from it, you will need to provide us with certain additional information. You can contact us using the contact details on the “Contact Us” page on our Website to obtain information on VAT exemption. Please note that when you make your first payment, the VAT inclusive amount will be charged. Once you have provided us with the required documentation, the VAT amount will be credited to your account and refunded within 30 days. VAT exemption only applies to eligible products, therefore we will only be able to refund the VAT on eligible products; VAT added to delivery charges is not refundable.

 

11. Rejection of Orders

 

11.1 We have the right to refuse or not fulfill any order at our sole discretion, including in the following situations:

 

A. The price or product description stated at the time of ordering is incorrect;

B. Your payment transaction is not confirmed;

C. If the product you want is out of stock;

C. Your delivery address is outside our service area; or

D. If shipping to the delivery address you specified is not possible or we have other concerns about the delivery address.

 

12. Payment Terms

 

12.1 We accept payment via credit card, debit card or digital payment methods.

 

12.2 All orders must be paid in full at the time the order is placed, unless otherwise stated and a payment plan or deposit payment option is not offered (in which case you will be notified on our website or at the time of your order). We reserve the right not to dispatch the ordered product(s) until we have received full payment.

 

12.3 Payment transactions may be subject to verification and authorization checks by the relevant card issuers and/or service providers. These transactions may be processed through third party providers in accordance with our Privacy Policy. If your card issuer or payment service provider refuses payment authorization, we will not be responsible for any delay or non-acceptance of your order.

 

12.4 If payment is rejected for any reason after the product has been shipped to you, we reserve the right to request payment or take back the relevant product. You may be charged for any costs incurred in the process of taking back the product or requesting payment.

 

12.5 We offer credit for products purchased from us, subject to eligibility and credit history. We can also provide you with information about credit opportunities when you place an order by phone or in store. Credit opportunities are provided by third party providers. 12.6 Title to any products ordered will remain with us until full payment is made. Once full payment has been made, title to the product will pass to you.

 

13. Delivery Conditions

 

13.1 We can only ship our products to delivery addresses in certain areas. If you are in a non-delivery area or would like to receive our products by another means, please contact us using the information on the “Contact” page on our website or via the contact information provided in the documents provided to you when purchasing in store.

 

13.2 Delivery is only made on weekdays (Monday-Friday, excluding public holidays) and a person over the age of 18 must be present at the address during delivery. As a rule, you cannot change the delivery address after placing an order. However, if you contact Quarest, our teams will investigate whether there is a solution they can find and try to help you.

13.3 Delivery dates are determined by stock status and delivery address. Estimated delivery dates are for informational purposes only and no exact date is guaranteed. However, once your order has been paid for, we undertake to deliver your product within 30 days. In case of exceptional circumstances during delivery, our Quarest team will contact you to agree on a different date.

 

13.4 Before delivery, you must inform us of any special conditions that may occur at your delivery address (such as low bridges, narrow roads) and/or problems with access to the facility (such as narrow doors, steps, etc.). You can contact us using the contact information provided on the “Contact” page on our website or in the documents provided to you when purchasing from the store. We recommend that you take the necessary measurements to detect such conditions in advance.

 

13.5 Our product deliveries are only made in door-to-door rollpack boxes, and the installation of the products you purchase will be entirely your responsibility.

 

14. Additional Delivery Charges

 

14.1 Additional delivery charges may apply in the following cases:

 

A. If the delivery cannot be made due to the absence of a person over the age of 18 at the delivery address on the delivery date and the delivery has to be repeated;

 

B. If you want to change the delivery address after the product has been shipped;

C If you fail to notify us in advance of special circumstances regarding the delivery (as per Article 13.4), the delivery cannot be completed or additional difficulties arise;

 

C. You do not accept delivery on the day our vehicles are located in your area and instead request delivery on a specific date or time slot.

 

15. Delivery Limitations

 

15.1 We would like you to know that we do not provide the following services. Otherwise, we will not be responsible in any way for any problems that may occur.

 

A. The process of moving your existing furniture at the delivery address

B. Moving or placing the product within a specified area within the delivery address.

 

15.2 Notwithstanding clause 16.5, responsibility for the product, including insurance and security matters, passes to you once the product has been delivered.

 

16. Explanations on the Right of Withdrawal, Right of Return and Trial Period

 

16.1 First of all, we would like to state that the products listed below, which are presented to you on our website, are goods whose protective elements such as packaging, tape, seal, package can be opened after delivery, and are in the category of goods that are not suitable for return in terms of health and hygiene. Therefore, as Quarest, we take into consideration the health of all our customers and even in products that are the subject of the Distance Sales Contract. YOU HAVE NO RIGHT OF WITHDRAWAL.

 

 

16.2 However, as QUAREST, in order to ensure the satisfaction of our customers, if you have ordered a product that is not specially manufactured or personalized according to your specifications when you place an order on the website or by phone, you can return your order within 14 days without giving any reason, provided that you have not opened or removed the product from its package from the date you received the product. If there is more than one product in your order, this period starts from the receipt of the last product. You must submit your return request to us in written form. The relevant return request is not a return request arising from the articles of the Consumer Protection Law, but a special arrangement written by QUAREST between the consumer and Quarest within the scope of this distance sales contract and terms of use. The acceptance of your return request is carried out by Quarest, and if accepted, the product must be delivered to the cargo companies or logistics companies notified by QUAREST without damaging or opening the packaging and without losing its hygiene. After the relevant return request is accepted by QUAREST, the cargo-logistics cost for the return will be covered by you. Once it is understood that the returned product has been delivered without any problems and has reached QUAREST, your return will be approved by QUAREST and your money will be refunded to you within ……… days. Neither the right of withdrawal nor the right of return can be used within the scope of the Consumer Law in purchases from the store.

 

 

16.3 To exercise your right to return, you can fill out the return request form on our website or make a written notification. If you make your cancellation request before delivery, we will do our best to stop the shipment, but we may not be able to prevent delivery if your order has been processed.

 

16.4 If you intend to exercise your right to return after receiving the product, the product must be kept unpackaged and ready for reshipment. Otherwise, due to hygiene reasons, we will only be able to take the product back in accordance with the Trial Period clauses. If you have exceeded the 14-day period for order cancellation when you place an order on the website or by phone, only trial periods offered for certain products may apply, as explained in Article 16.5 below. This trial period does not apply to products that have been customized upon your request.

 

16.5 The 120 Night Trial is only valid for bedding collections and does not apply to pillows, separately sold washable mattress covers and customized products. If you wish to return the product during the trial period, we kindly ask you to pack the product with its packaging in a double nylon package so that it does not stain and send it back. If you wish to return the product during the trial period, your product will be refunded with a 20% deduction (loss of product value and logistics costs) from the current VAT-included amount you purchased. If the product is excessively dirty or damaged or deformed, we reserve the right not to accept the product back.

 

16.6 The right to exchange applies to products included in the trial period, and at the end of the trial period you can request to exchange your product for another product. Exchange can only be made once and a second trial period is not offered.

 

16.7 If you do not submit your return or exchange request during the trial period, you will be deemed to have accepted the product and your right to return will be void. You can contact us for more information about the Trial and Return conditions.

 

16.8 The trial period for outlet products is limited to 30 nights and is only valid for beds. If you want to return the product during the trial period, we kindly ask you to pack the product in the original packaging as a double-layer package and send it back. If you want to return the product during the trial period, the product will be refunded by applying a 20% deduction (product packaging + logistics costs) from the current VAT-included amount you purchased with a discount in the outlet program. If the product is in a different condition than when it was delivered, is excessively dirty or damaged, deformed, and in a condition that prevents use, we reserve the right not to accept the product back.

 

17. Damaged, Faulty or Incorrect Products

 

17.1 We recommend that you keep all warranty documents and warranty information that came with the product you received. These documents will help you in case of any problems you may experience during the warranty period of the product.

17.2 We kindly ask you to examine the products delivered to you carefully after receiving them. If the product you received is damaged or faulty within the warranty period, we kindly ask you to inform us and send the product back to us by mail or request that we collect the product. C. If an equivalent product is not available, we will refund all amounts you paid, including the purchase price and the costs of returning the product to us. We kindly ask you to follow our return policy as stated in Article 18 for your returns.

 

17.3 If we find that the product you returned is not damaged or faulty, we may send it back to you and cancel your refund request. If a refund has already been made, we may refund your payment using the information you provided. We may also charge you for the cost of sending the product back to you and collecting it back.

 

17.4 If the product you receive is not what you ordered, please let us know and return the product by post or by collecting it from us. In this case:

A. If possible, we will send you the product you ordered; or

B.  If the item you ordered is not in stock, we will refund the purchase price and delivery costs.

 

17.5 For all such returns, you must follow our returns policy set out in Clause 18.

17.6 Note: The return and exchange policy for products sold at the outlet is determined according to the outlet procedure and sales terms and conditions.

18. Return Policy

 

18.1 If you wish to return a product that meets the return conditions, please use the Return Request Form on our website or send us an email at [sample address]. If you are unable to send an email, you can contact us in writing. We will provide you with a return number based on your return request and we kindly ask you to use this number in all correspondence (otherwise the processing time may be longer).

 

18.2 If you want to return a mattress with a trial period that has been opened by the user with its original packaging within the 90-120 days or before and request us to pick up the product, a 20% deduction will be applied to the current sales amount including VAT that you have purchased. (This price is only valid for regions where delivery can be made within the land borders of Turkey) and you will be given a date before the product is delivered. If you request delivery on a specific date and time, additional fees may be applied. If you cannot prepare the product for pick up on the specified date, an additional second round shipment fee of 1200 TL (1000 + VAT This price is only valid for regions where delivery can be made within the land borders of Turkey) will be paid for unsuccessful pick up. Pillows that are in the hygienic category and do not offer a trial period and washable covers sold separately cannot be returned or exchanged after the original package is opened.

 

Note: The amounts in situations in 17.3 may vary depending on the distance and shipping costs of countries outside of Türkiye, and are calculated and reflected to the consumer when such situations occur.

 

18.3 In order to ensure the safety of the returned products during transport, you will be double-packaged and you must state your name, address and order number on the product. We recommend that you receive a shipping receipt when sending the product. Make sure that the products are securely packaged, as returns may not be accepted in the event of damage or contamination. We recommend that you use the original packaging when returning. If necessary, you can contact us for additional suitable packaging (500+VAT).

 

18.4 If we find that the products returned to QUAREST are dirty or damaged, we may not collect them or may return them. If the products are found to be dirty or damaged when they arrive to us, we reserve the right to refund the products to you and/or request a full refund. You authorize us to use the payment information you provided at the time of order to collect these payments.

 

Refunds

 

19. Any refunds due under these Terms and Conditions will be processed using the same payment method you used when you placed your order. Please note that bank transactions are beyond our control and banks can take up to 14 days to complete a refund. Once a refund request has been submitted to the bank, we are unable to speed up the process.

 

19.2 If, despite clauses 18.3 and 19.1, you are returning a mattress after a home trial period, we will endeavour to process your return as quickly as possible. The returns process is based on the condition that the product is returned to you.
This involves our couriers collecting the item from your original delivery address and returning it to us for inspection. This process can take up to 28 days. As stated in clause 19.1, once the refund request has been sent to the bank, it can take up to 14 days for the bank to complete the transaction. 

 

20. Use of Products

20.1 You agree to use the products only for their original intended use and not to make any changes, modifications or interventions to the products. Our company is not responsible for any problems arising from the use of the products for purposes other than their design.

 

20.2 You undertake to fully comply with the instructions for use provided with the product and not to use the products in a careless, faulty or negligent manner. Please note that damages and problems that may arise as a result of improper use of the products may be excluded from the warranty.

 

21. Data Protection

 

21.1 The way we process and manage your Personal Data is included in the Information text, and you can also review our Cookie Policy regarding the cookies on the website.

 

22. Invalidity and Waiver

 

22.1 If any provision or portion of any provision of these Terms and Conditions is held to be invalid, illegal or unenforceable, it will not affect the validity or enforceability of any remaining provisions. The invalid provision will be reformed or interpreted to the fullest extent permitted by law to best reflect the intention of the parties.

 

22.2 If we fail to act if you breach these Terms and Conditions, this does not waive our rights to deal with future breaches. Our failure to act on past breaches will not limit our ability to enforce the same or similar breaches in the future.

 

23. Third Party Rights

 

23.1 No person who is not a party to these Terms and Conditions, other than our affiliates, directors, employees or agents, shall have the right to do so, provided that it complies with applicable law. It has no right to enforce any rights arising from the Terms and Conditions or to assert any claims based on these Terms and Conditions.Without prejudice to the regulations regarding the Right to Return and Exchange in the event that you have not placed an order, either party may terminate a contract under these Terms and Conditions at any time by giving written notice to the other party.

 

23.2 Together with this Clause 23, Clauses 1, 3, 4, 7, 10, 18, 19, 22, 24, 26 shall survive termination of a contract under these Terms and Conditions.

 

24. Transfer and Subcontracting

 

24.1 We reserve the right to transfer or subcontract our rights and obligations under these Terms and Conditions in whole or in part. If your rights and obligations change significantly as a result of such transfer, we will notify you of this and you will have the right to revoke your acceptance of these Terms and Conditions if the products have not yet been delivered to you.

24.2 These Terms and Conditions are personal to you and are for your benefit. You may not assign or transfer your rights under these Terms and Conditions to a third party.

 

25. Applicable Law and Jurisdiction

 

25.1 Overseas Supplier must ship the goods to the designated destination and bear the shipping cost as well as other fees and risks before handing over the goods to the buyer. The buyer needs to carry out import customs procedures and bear the import tax.

 

Note:These customs procedures and taxes can be between 15-20% on average. However, they may vary depending on the legislation of the country. Please do not forget to check your country's customs taxation and taxation amounts before purchasing the product. In case there is no production problem in international deliveries, shipping and customs fees for returns and exchanges are paid by the buyer.

 

25.2 These Terms and Conditions shall be subject to and interpreted in accordance with the local laws in force in the Republic of Turkey, where our company is affiliated. All disputes that may arise in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts and enforcement offices of Izmir Courthouse. What is this deep sleep phase and why is it so important?

 

This phase (N3), also known as the 3rd stage of sleep, is the sleep phase in which brain waves slow down, muscle activity decreases, heart rate and respiratory rate drop to their lowest levels and the body completely relaxes.

The deep sleep phase accounts for approximately 20-25% of total sleep time and is the most difficult sleep phase to wake up from. During this phase, the body refills its energy stores and the immune system is strengthened against diseases.
