  1. SUBJECT

The subject of this Preliminary Information Form (“Form”) is to inform the consumer regarding the sale and delivery of the product whose quality and sales price are specified below, in accordance with the provisions of the Law on the Protection of Consumers No. 6502 and the Regulation on Distance Contracts published in the Official Gazette dated 27 November 2014 and numbered 29188 (“Regulation”). In addition, information regarding the issues in articles 5/1, d, g and h are included in this Form in accordance with the Regulation.

The prices listed and announced on the site are the sales price including all taxes. The announced prices and conditions are valid until updated.

Your order will be delivered within 6502 (thirty) days from the date of order in accordance with the provisions of the Consumer Protection Law No. 30.

Unless otherwise provided, the delivery costs of the product belong to the BUYER. If the SELLER has declared on the Website that the delivery costs will be covered by the SELLER, the delivery costs will belong to the SELLER.

The product/products will be delivered to the delivery point selected by the BUYER by the cargo company that the SELLER has an agreement with. The SELLER shares the shipping area of ​​the cargo company with the BUYER. If the BUYER's delivery address is outside the shipping area, the SELLER has the right to cancel the order. In the event of cancellation of the order, if the product price has been collected, it will be returned to the BUYER.

If the BUYER requests the product to be sent with a cargo company other than the one determined by the SELLER, the SELLER will not be held responsible for any loss or damage that may occur after the product is delivered to the relevant cargo company.

If the product is to be delivered to a person/organization other than the BUYER, the SELLER is not responsible for any extra shipping costs that may arise from the person/organization to whom the delivery is made not accepting the delivery, incorrect shipping information and/or the BUYER not being at their location. If the product/products have not reached the customer within the specified days, delivery problems can be reported to customer services by e-mail info@quarest.com  should be reported immediately.

 

  1. PERIOD OF VALIDITY

 

All information and promises provided to the BUYER regarding the product in this Form are valid until the campaign publication period and the SELLER hereby warns that the information and promises provided in this Form will not be adhered to after today. If the product purchased by the BUYER is not in the BUYER's supplier stocks at the end of the campaign publication period and an equivalent product of equal quality and price is not available, the SELLER reserves the right to refund the price paid by the BUYER.

 

  1. RIGHT TO WITHDRAWAL

BUYER does not have the RIGHT OF WITHDRAWAL in distance contracts regarding product sales and within the scope of the articles regulated within the scope of the sales terms and conditions published on this site. However, BUYER'S RIGHT OF RETURN and the conditions for using the RIGHT OF RETURN are regulated in detail in the distance sales contract. 

In order for the BUYER to exercise his right of return, 

In order to prevent any grievances on the part of the SELLER and the BUYER, if the goods sold within the scope of this preliminary information are not manufactured or personalized according to the BUYER's special requests, the BUYER may return the order within 14 days without giving any reason, provided that the product has not been opened or removed from its packaging from the date of receipt of the product. 

 

  1. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

If the sleeping products (bed, pillow, quilt, etc.) sold by the SELLER are within the scope of the right of withdrawal period, but after delivery, it is determined that the product has suffered a stain or deformation caused by the BUYER, which would make it unsuitable for resale, the BUYER will not be able to exercise his right of withdrawal. However, the right of return may be exercised. 

 

Unless otherwise agreed by the parties, the BUYER cannot exercise the right of withdrawal in the following situations and contracts:

 

  1. a) Contracts for goods or services whose prices vary depending on fluctuations in financial markets and are not under the control of the SELLER or the provider,

 

  1. b) Contracts regarding goods prepared in line with the BUYER's requests or personal needs.
  2. c) Contracts for the delivery of perishable or expired goods.
  3. d) Contracts regarding the delivery of goods whose protective elements such as packaging, tape, seal, or package have been opened after delivery; and whose return is not suitable for health and hygiene reasons.
  4. e) Contracts concerning goods that are mixed with other products after delivery and cannot be separated due to their nature.
  5. f) Contracts regarding books, digital content and computer consumables presented in material form, if protective elements such as packaging, tape, seal, package have been opened after delivery of the goods.
  6. g) Contracts regarding the delivery of periodicals such as newspapers and magazines, other than those provided within the scope of a subscription contract.
  7. h) Contracts related to accommodation, goods transportation, car rental, food and beverage supply and the evaluation of free time for entertainment or recreation purposes, which must be made on a specific date or period.
  8. j) Contracts regarding services that are started to be performed with the consumer's approval before the expiry of the right of withdrawal period.

The right of withdrawal cannot be exercised in respect of goods or services that are excluded from the scope of the Distance Contracts Regulation (foodstuffs, beverages or other daily consumption items delivered to the Buyer's home with the Seller's regular deliveries and services in areas such as travel, accommodation, restaurant business and entertainment sector).

Pursuant to Article 13/2 of the Regulation, the BUYER is not responsible for any changes or deteriorations that occur if the product is used in accordance with its operation, technical specifications and instructions for use within the withdrawal period.

 

 

  1. GENERAL PROVISIONS

If the BUYER selects the corporate invoice option for the orders placed via the Website, the SELLER will issue a corporate invoice. The SELLER will issue the corporate invoice in accordance with the tax identification number and tax office information that the BUYER will provide via the Website. It is the BUYER's sole responsibility to enter the specified information accurately and completely.

 

If the Products are not at the BUYER's address at the time of delivery, the SELLER will be deemed to have fulfilled its obligation fully and completely. If there is no one at the address to receive the Products, it will be the BUYER's responsibility to contact the cargo company and follow up on the shipment of the Products.

The BUYER is responsible for checking the product upon receipt and, if he/she sees a problem with the product caused by the cargo, not accepting the product and having a report drawn up by the cargo company officer. Otherwise, the SELLER will not accept any responsibility.

Unless otherwise stipulated in writing by the SELLER, the BUYER must have paid the price in full before receiving the product. In cash sales, if the Product price is not paid in full to the SELLER before delivery, and in installment sales, if the due installment amount is not paid, the SELLER may unilaterally cancel the contract and not deliver the product. If, for any reason after the delivery of the Product, the bank/financial institution to which the credit card used for the transaction belongs does not pay the Product price to the SELLER, the Product shall be returned to the SELLER by the BUYER within 3 days at the latest, with all expenses being borne by the BUYER. The SELLER reserves all other contractual and legal rights, including the right to pursue the receivable price of the Product without accepting the return.

If the product cannot be delivered within the legal 30-day period due to extraordinary circumstances (such as adverse weather conditions, heavy traffic, earthquake, flood, fire) outside of normal sales/delivery conditions, the SELLER will inform the BUYER about the delivery. In this case, the BUYER may cancel the order, order a similar product or wait until the extraordinary situation ends.

In case of order cancellations, if the product price has been collected, it will be returned to the BUYER. In credit card payments, the refund will also be made by returning it to the BUYER's credit card and the product amount will be returned to the relevant bank after the order is cancelled by the BUYER; since the reflection of this amount to the BUYER's accounts after its return to the Bank is completely related to the Bank's transaction process, the BUYER accepts in advance that it will not be possible for the SELLER to intervene in any way and assume responsibility for possible delays. (The process of reflecting the refund to the BUYER's account by banks can usually take up to 3 (three) weeks).

If it is understood that the products subject to the contract cannot be supplied due to a justified reason other than extraordinary circumstances, the SELLER may supply another product of equal quality and price by informing the BUYER and obtaining his approval within 3 (three) days from the date of learning of the situation, and shall be deemed to have fulfilled his commitment subject to the Contract. In cases where the BUYER does not give approval, the provisions regarding order cancellation shall apply.

 

  1. VALIDITY

After this Form is read and accepted by the BUYER in electronic environment, the Distance Sales Contract establishment phase will begin.

  1. DISPUTE RESOLUTION METHODS

BUYER may apply for complaints and objections to the consumer problems arbitration committee or consumer court where BUYER purchased the product or where he/she resides, within the monetary limits determined by the Ministry of Trade in December of each year.

What is this deep sleep phase and why is it so important?

 

This phase (N3), also known as the 3rd stage of sleep, is the sleep phase in which brain waves slow down, muscle activity decreases, heart rate and respiratory rate drop to their lowest levels and the body completely relaxes.

The deep sleep phase accounts for approximately 20-25% of total sleep time and is the most difficult sleep phase to wake up from. During this phase, the body refills its energy stores and the immune system is strengthened against diseases. In addition, processes such as cell renewal and tissue repair occur during this phase, with the secretion of growth hormone.
